The preliminary search is the most important and critical step. In Mexico, there are more than 1.6 million active trademarks. Submitting an application without a professional search is like crossing the street blindfolded: you risk rejection due to conflict with an identical or similar trademark already registered, wasting time, money (the official fee is non-refundable), and the opportunity to protect your name.
Your application will be denied by the Mexican Institute of Industrial Property (IMPI). You will lose the government filing fee (which is non-refundable) and, worse still, you will have alerted the owner of the earlier trademark, and may face a lawsuit for infringement if you use that name.
